讲座简介：
AI - including agentic AI - is rapidly gaining ground in contractual contexts. The Principles for AI in Contracting (PAIC), developed by Wendehorst, address how contract law, long designed for human actors, should operate when AI agents are involved, including in hybrid human-AI settings. These principles have significantly shaped UNCITRAL’s Model Law on Automated Contracting (MLAC) and underpin the EU’s recent initiative to develop model contractual terms for AI contracting.
人工智能（包括代理型人工智能）正迅速应用于合同交易场景。由本次讲座主讲人Wendehorst教授主持制订的《人工智能参与合同活动原则》（Principles for AI in Contracting，PAIC），旨在回应如下核心问题：合同法这一原本围绕人类行动者构建的法律体系，如何应对AI代理（包括人机协同混合场景）参与合同活动的新情况。该《原则》不仅对联合国国际贸易法委员会（UNCITRAL）制定的《自动化缔约示范法》（Model Law on Automated Contracting，MLAC）产生了重大影响，也构成欧盟近期制定“人工智能缔约示范合同条款”（Model Contractual Terms for AI Contracting）动议的重要基础。
